Execution of state administration in matters concerning rails of the I and II Degree, pursuant to Act no. 2/1969 Coll., On the Establishment of Ministries and Other Central State Administration Bodies of the Czech Republic, as amended, Act no. 50/1976 Coll., On Zoning and Construction Rules (the Building Code), as amended, Act no. 552/1991 Coll., On State Inspection, as amended, Act no. 266/1994 Coll., On Rail Systems, as amended, Act no. 22/1997 Coll., On Technical Requirements for Products and On Changing and Amending Certain Acts, as amended, Act no. 77/2002 Coll., on the Czech Railways Joint Stock Company (akciová společnost České dráhy), State Organisation Railway Infrastructure Administration (státní organizace Správa železniční dopravní cesty), and On Changing Act no. 266/1994 Coll., On Rail Systems, as amended, and Act no. 77/1997 Coll., On Public Corporations, as amended (hereinafter referred to as Act no. 77/2002 Sb.); 1.2. Ensuring the execution of state supervision, and state supervision in matters concerning railways, pursuant to Act no. 266/1994 Coll., On Rail Systems, as amended; 1.3. Verification of the professional competence to perform ultimate state supervision and state supervision in matters concerning railways; 1.4. Executing the conceptual, norm-drafting, and professional work, of a central administration body pertaining to railway transportation routes and railway vehicles; 1.5. Ensuring legislative activity in the matter of rail systems and combined transport; 1.6. Verification of the professional competence of natural persons to perform tests of specific technical equipment in operation; 1.7. Ascertaining the professional competence of safety advisers for the transport of dangerous goods by rail; 1.8. Assignment of feasibility studies and zoning and technical studies for the development of the railway transportation route; 1.9. Drafting of conceptual plans for the development and modernisation of railway transportation routes and combined transport, in line with the Czech transport policy, and as tied to the development of the European railway network, and dealing with initiatives related to the modernisation and renovation of the railway transportation route; 1.10. Drafting opinions on zoning plans, and the reflection of the plans for the development of railways and railway transportation into them; 1.11. Assessment and elaboration of opinions on conceptual materials for the development of railways, railway transport and combined transport; 1.12. Assessment of the feasibility of construction projects financed from public funds, both on country-wide and regional rails; 1.13. Elaboration of a concept for the privatisation of railway lines; 1.14. Preparation (discussions of experts) and discussion on proposed bilateral and multilateral international conventions, which regulate co-operation in the sphere of railway and combined transportation across the border of the Czech Republic with another convention party (primarily neighbouring states), the compliance with bilateral international treaties on combined transport (mixed committees), and evaluation of compliance with signed treaties (within the Section’s scope of responsibilities); 1.15. Arranging for international meetings concerning the railway transport of hazardous items; 1.16. Taking care of work in the committee for border crossings, concerning changes in the character of railway border crossings (renovation, new, changes in technologies, etc.) with neighbouring states (the Czech Ministry of the Interior is responsible for changing the nature of border crossings); 1.17. Ensuring the work which arises for the country from its membership in the TER project in ECE/UN; 1.18. Ensuring work in international organisations for which the Section is responsible [e.g., CEMT (working group for railways), ECE/UN-SC2 (working group for railways), the TER Project (trans-European railway) of ECE/UN, CEMT (group for inter-modal transport and logistics), ECE/UN (working group for combined transport – WP 24), JCPR (joint programme committee for railways), CEN TC 256 (railway norms), CENELEC TC 9X (railway norms)]; 1.19. Processing of materials concerning railways and railway and combined transportation for the MT appeal committee; 1.20. Methodological management of the Railway Authority (Drážní úřad) and Railway Inspectorate (Drážní inspekce); 1.21. Ensuring that the Ministry sections responsible for matters concerning railways issue their opinions for ČD, a.s., and SŽDC, s.o.; 1.22. Elaboration of opinions on economic and asset-related matters of ČD, a.s., and SŽDC, s.o.; 1.23. Creation of conditions for the operation of combined transport, including its system support, also in connection to the implementation of international projects; 1.24. Work of working committees in matters concerning railways and combined transport; 1.25. Processing of the opinions of the responsible section on the use of state-owned assets; 1.26. Processing of opinions on public service obligations in rail transportation; 1.27. Methodological directing of conditions in domestic rail transportation and the elaboration of methodological processes to be followed in railway transportation; 1.28. Formulates or evaluates proposals of Community Law, in matters concerning the operation of a railway and of rail and combined transport; analysis of the legal and factual situation, with a view to the interests of the Czech Republic; 1.29. Elaboration of background materials for negotiation with the City of Prague, Regions, and other institutions, in their co-operation in ensuring the development of the operation of railways and railway transportation (memoranda); 1.30. Administration, preparation, and implementation of programmes, within its sphere of responsibility, for co-financing from the state budget, in order to obtain subsidies from EU structural funds; 1.31. Assessment of projects concerning railways, combined and railway transports, as to the possibility of obtaining funds from EU structural funds, and from public budgets (the government budget), including control and evaluation of the implementation of those projects. 2. Its responsibilities also include: 2.1. The determination and elaboration of: – Drafts of international conventions and agreements between ministries of transport, concerning railway border crossings, easier transit railway transportation, and co-ordinated development of railway transportation (primarily of the railway transportation route) and of combined transportation; – The scope and conditions for railway and combined transport, in order to ensure that the country’s transport needs are met. 2.2. Decisions: – To include a new railway in a given category; – To change draft international conventions and agreements between ministries of transport concerning railway border crossings, easier transit railway transportation, and co-ordinated development of railway transportation (primarily of the railway transportation route) and of combined transportation; – To change the category of a nation-wide railway into another railway category, and to change the category of a railway other than a nation-wide, to a nation-wide railway; – In matters concerning the shutting down of country-wide and regional railways; – In appeal procedures against the decisions of railway administration bodies; – In appointing legal persons as the authorised authorities, according to the Rules for International Railway Transportation of Dangerous Items (RID); – In questionable cases, concerning agreements on the manner of ensuring the operation of a railway transportation route, its operability, modernisation, and development, in the public interest. 2.3. Co-operation: – With the State Transportation Infrastructure Fund (SFDI) and the Section for EU funds on matters concerning the provision of a subsidy for the maintenance and repair of transportation routes of railway operators other than ČD a.s.; – With the ČD, a.s. and SŽDC, s.o. management bodies; – With the Authority for Technical Normalisation, Metrology, and State Testing in determining the person authorised for the certification of elements, parts, and subsystems of the railway system; – In ensuring ministry statistics on railway operation, and in the operation of railway and combined transportation; – With SFDI and the Section for EU Funds, in the preparation of investment construction, renovation, and modernisation of the railway transportation route; – In creating European norms in the European Committee for Railway Applications (CEN/TC 256), and at meetings of the International Organisation for Railway Transportation (OTIF), concerning railway vehicles; – In addressing issues concerning the approval of containers and swap bodies, including the related EU technical norms and technical regulations; – In determining the scope and terms and conditions for public service undertakings in rail transportation. 2.4. Coordinates: – And performs tasks arising out of the transformation of the Czech Rail Company (ČD, a.s.) according to Act no. 77/2002 Coll.; – And arranges for the preparation and verification of the special professional competence of the officials of regional self-administering units, for the execution of administrative activities in administrative decision-making, in the operation of the railway and rail transportation, within the meaning of Act no. 312/2002 Coll., On the Officials of Regional Self-administering Units and On Changing Certain Acts, as amended, – The work of railway operators, including the determination of the serviceability of a railway transportation route in the case of rails owned by the state. 2.5. Represents: – The Ministry in working groups and committees of the European Commission and Council and in international organisations within the scope of the Section’s responsibilities, such as the EC Committee for the Development of Community Railways, the EC Interoperability Committee, the TER Project (trans-European railway) of the ECE/UN, CEMT (working group for railways) ECE/UN -SC2 , JCPR (joint programme committee for railways), CEN TC 256 (railway norms), CENELEX TC 9X (railway norms); – In the working group for inter-modal transport and logistics ECE UN (WP 24), including the execution of the measures adopted; – In the CEMT working group for inter-modal transportation and logistics.
